1. Introduction

FRANK LENGYEL, P.A. ("Company," "we," "our," or "us") is committed to protecting your privacy and securing your real estate transaction data. This Privacy Policy explains how we collect, use, disclose, and secure your personal information when you visit our website (frankrfl.com), browse Miami MLS listings, request Comparative Market Analyses (CMAs), or engage our real estate brokerage and agent services. Please read this privacy policy carefully. If you do not agree with its terms, please do not access the site or utilize our real estate services.

2. Information We Obtain

We collect information you provide directly to us in connection with your property search or real estate listing. The information we may collect includes: Personal Data (name, email address, phone number, and current mailing address); Property Information (target Miami-Dade neighborhoods, desired square footage, budget ranges, and property addresses for sale); Financial Data (mortgage pre-approval status and proof of funds); Communication Data (records of emails, phone calls, and text messages related to property showings); and Usage Data (information about how you navigate our property search tools).

3. Purpose of Data Usage

We use the information we collect strictly to operate our real estate brokerage business. This includes: curating custom property listing alerts, scheduling open house tours, coordinating with title companies and escrow agents, submitting purchase offers, and responding to your direct customer service inquiries. We do not use your personal information to send generalized promotional marketing outside of your specific real estate interests.

4. Text Messaging Communication

If you provide explicit, verifiable consent to receive text messages from us, we may send you automated SMS/MMS messages strictly regarding your active real estate transactions or property searches. These operational messages include showing appointment confirmations, urgent deadline reminders during the escrow period, new MLS listing alerts matching your exact criteria, and secure document signature links. Message frequency varies based on your active transaction phase, and you will be provided with clear opt-out instructions. Standard message and data rates may apply. You can opt-out at any time by texting STOP to any message you receive from us. Text HELP for assistance.

5. Mobile Consent Protection

Your consent to receive text messages is completely voluntary. The SMS opt-in checkbox provided on our property inquiry forms or consultation portals is explicitly not mandatory to check. You can secure our buyer or seller representation services without agreeing to receive text messages. Opting out of text messages will not affect your ability to retain FRANK LENGYEL, P.A. for your real estate needs. We will continue to send essential transaction communications via email or phone calls.

6. Third-Party Data Sharing Restriction

We strictly protect your mobile data and uphold client confidentiality. Under no circumstances do we share, sell, rent, or trade your mobile phone number or SMS opt-in consent data with any third parties, affiliates, mortgage lenders, title companies, or external marketing agencies. Mobile opt-in consent data and phone numbers are never shared for any purpose.

7. Disclosure Practices

We may share your general transaction information only in the following limited operational scenarios to facilitate your real estate closing: Service Providers (sharing necessary contract data with trusted transaction coordinators, escrow officers, or municipal inspectors); Legal Requirements (if required by law, court order, or Florida real estate regulatory mandates); and Business Transfers (if we are involved in a merger or sale of the brokerage). However, this explicitly excludes mobile phone numbers and SMS opt-in consent data; mobile information is never shared with any third parties under any circumstances.

8. Security Measures

We implement rigorous technical and organizational security measures to protect your sensitive financial and property information against unauthorized access, alteration, disclosure, or destruction. These measures include secure servers, encrypted digital portals for purchase agreements, and strict physical access controls to our Miami office records. However, no method of transmission over the Internet or electronic storage is completely secure, and we cannot guarantee absolute security.

9. Your Rights

Depending on your location, you may have the following rights regarding your personal information: the right to access and receive a copy of your personal data and transaction history; the right to correct inaccurate property requirements or contact information; the right to request deletion of your personal information (subject to Florida real estate broker record retention laws); the right to restrict or object to certain processing of your data; and the right to withdraw consent for administrative communications. To exercise any of these rights, please contact us.

10. Cookies and Tracking

We may use cookies and similar tracking technologies to collect information about your browsing activities on our website. Cookies help us understand how you use our property search features, remember your saved listings, and improve your digital experience. You can control cookie settings through your browser preferences.

Our real estate brokerage services are directed exclusively to adult property buyers, sellers, and investors. We do not knowingly collect personal information from individuals under the age of 18. If you become aware that a child has provided us with personal information, please contact us immediately so we can delete such information.

The specific scope of your agency relationship with FRANK LENGYEL, P.A. will be defined exclusively by a separate, fully executed written agreement, such as an Exclusive Right of Sale Listing Agreement or an Exclusive Buyer Brokerage Agreement.

3. Property Information and MLS Disclaimer

Information provided on our website regarding real estate listings, including square footage, property taxes, HOA fees, and availability, is deemed reliable but is not guaranteed. Listing data is sourced from third parties and the MLS, and is subject to errors, omissions, price changes, or withdrawal without notice. All transaction deposits must be wired directly to a licensed Florida title company or an attorney’s trust account as designated in your purchase agreement.

5. Agency Relationship Disclaimer

Using our website or submitting a property inquiry does not automatically create a Single Agent or Transaction Broker relationship. A formal real estate agency relationship is only established upon the execution of a written brokerage disclosure and agreement in compliance with Florida real estate statutes.

6. Property Showings and Open Houses

When attending property showings or open houses scheduled through our brokerage, you agree to comply with all safety guidelines and homeowner rules. The Company is not liable for any personal injury or property damage that occurs while visiting a third-party listing.

8. Third-Party Service Recommendations

During a transaction, our agents may provide a list of local vendors, including home inspectors, mortgage lenders, and title insurance companies. These are provided as a courtesy only. We do not guarantee the performance of any third-party vendor, and clients are encouraged to independently interview and select their preferred service providers.

9. Limitation of Liability

The Company maintains active real estate errors and omissions (E&O) insurance. However, to the fullest extent permitted by law, our aggregate liability arising out of any real estate transaction or use of our website is strictly limited. We are explicitly not responsible for undisclosed property defects by a seller, fluctuations in real estate market values, or any indirect, incidental, consequential, or punitive damages.

10. Mobile Communication Terms

If you voluntarily opt-in to receive text messages from us, you agree to receive automated SMS/MMS messages strictly for operational real estate transaction management. These messages include showing appointment confirmations, urgent deadline reminders during the escrow inspection period, new MLS listing alerts matching your criteria, and secure digital signature links (e.g., DocuSign). We do not use text messaging for generalized marketing campaigns. Message frequency will vary based on your active property search or transaction phase. Message and data rates may apply. We do not share, sell, rent, or trade your mobile phone number or SMS opt-in consent data with any third parties, affiliates, mortgage lenders, title companies, or external marketing agencies for any purpose.

11. Intellectual Property

All custom property listing descriptions, proprietary market reports, website design, and professional listing photography created or provided by FRANK LENGYEL, P.A. remain the exclusive intellectual property of the Company. These materials may not be reproduced, distributed, or scraped by third-party platforms without our express written permission.
